Terms of Service for FernMath

1. Acceptance of Terms

By accessing or using FernMath, you agree to:

• Be bound by these Terms of Service
• Comply with our Privacy Policy
• Use the app in accordance with all applicable laws

If you're under 18, you must have permission from a parent or guardian to use FernMath.

2. Description of Service

FernMath is a free educational web application that provides:

• Interactive algebra lessons and problems
• Drag-and-drop mathematical expression manipulation
• Progress tracking and achievement system
• Cross-device learning synchronization

Educational Purpose: FernMath is designed as a learning tool for students in grades 6-9 to develop algebraic thinking skills.

3. Account Registration

Creating an Account

• You must sign in with a valid Google account
• You must provide accurate information
• You're responsible for maintaining account security
• One person per account - no sharing

Account Requirements

• Must be at least 11 years old with parental permission
• Must use a valid email address
• Must not impersonate others
• Must not create multiple accounts to abuse the service

4. User Conduct

You agree to use FernMath responsibly and NOT to:

• Cheat, exploit bugs, or manipulate progress tracking
• Attempt to access other users' accounts or data
• Use automated tools (bots, scripts) to interact with the app
• Reverse engineer, decompile, or hack the application
• Upload malicious code or attempt to compromise security
• Harass, abuse, or harm other users
• Use FernMath for any illegal purpose

• Learn algebra concepts at your own pace
• Practice problem-solving strategies
• Track your progress and celebrate achievements
• Provide constructive feedback to improve the app

⚖️ Consequences for Violations

We reserve the right to immediately suspend or terminate your account, without warning or refund, if you:

• Reverse engineer, decompile, or attempt code extraction
• Create derivative works or competing products based on FernMath
• Violate intellectual property protections described in Section 5
• Engage in any prohibited activities listed above
• Use FernMath in ways that harm other users or the service

Termination is immediate and permanent. We may also pursue legal remedies including injunctions and damages for intellectual property violations.

5. Intellectual Property

Our Content

FernMath and all content (including Fern the Arctic Fox character, lesson materials, problem sets, graphics, code, algorithms, and user interface designs) are owned by Dasasian Games, LLC and protected by copyright, trademark, and intellectual property laws.

You may:

• Use FernMath for personal educational purposes
• Share screenshots for educational discussion

You may NOT:

• Copy, modify, redistribute, or reverse engineer FernMath code or content
• Use Fern character or FernMath branding for any purpose
• Create derivative works based on FernMath
• Sell or sublicense access to FernMath
• Extract, replicate, or analyze proprietary systems (see Trade Secrets below)

Character & Visual Design Protection

Fern the Arctic Fox is a distinctive copyrighted and trademarked character owned by Dasasian Games, LLC. Protected elements include:

• Visual design: Cream/white fur, ice blue eyes, geometric rounded art style, and all character artwork
• Character personality: Voice, expressions, and supportive coaching demeanor
• Arctic theme: Winter pine visual aesthetic and color palette
• All poses and animations: Waving, celebrating, thinking, and all character expressions

You may NOT:

• Create substantially similar characters for educational products or services
• Use arctic fox characters in algebra, mathematics, or STEM learning applications
• Copy or imitate FernMath's visual style, color scheme, or design system
• Create works that could cause confusion with FernMath or Fern branding

"Substantially similar" means characters, designs, or products that a reasonable person might confuse with Fern or associate with FernMath.

Trade Dress & Visual Identity

FernMath's distinctive trade dress (overall look and feel) is protected and includes:

• Arctic/winter theme with cool color palette (Winter Pine blues, grays, and mint accents)
• Rounded geometric typography and soft professional aesthetic
• Drag-and-drop mathematical manipulation interface
• Combination of interactive algebra + arctic fox mascot + Brain Fuel economy

This unique combination of visual and interactive elements creates a distinctive trade dress that is protected from imitation.

Proprietary Systems & Trade Secrets

The following are proprietary trade secrets of Dasasian Games, LLC and are protected as confidential business information:

• Brain Fuel economy: Scoring algorithms, reward systems, and progression mechanics
• Problem difficulty systems: Adaptive difficulty, problem sequencing, and challenge calibration
• Drag-and-drop interaction patterns: Mathematical manipulation behaviors, gesture recognition, and UX flows
• Educational pedagogy: Lesson design, hint systems, and learning progression strategies

You agree NOT to:

• Analyze, extract, reverse engineer, or replicate these proprietary systems
• Create derivative works or competing products based on FernMath mechanics or design
• Use knowledge gained from FernMath to build similar educational products or services
• Decompile, disassemble, or attempt to discover source code or algorithms

No Derivative Works

You may not create applications, games, educational tools, or any products that:

• Copy or substantially replicate FernMath's drag-and-drop algebra interaction model
• Imitate the Brain Fuel scoring, economy, or reward systems
• Use similar UI/UX patterns for mathematical expression manipulation
• Are derived from, based on, or substantially similar to FernMath in concept or execution
• Compete with FernMath in the algebra education market using similar methods or designs

Creating derivative works is a violation of copyright law and these Terms, and may result in immediate account termination and legal action.

Your Content

Your problem solutions and progress data belong to you. By using FernMath, you grant us a license to:

• Store and display your data within the app
• Use aggregated, anonymized data to improve FernMath
• Display your achievements within your account

6. Privacy & Data

Your privacy is important. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms.

Key points:

• We collect minimal data needed for the app to function
• We protect your data with industry-standard security
• We never sell your personal information
• You can delete your account and data at any time

7. Educational Disclaimer

Not a Substitute for School

FernMath is a supplementary learning tool. It does not:

• Replace formal mathematics education
• Guarantee improved grades or test scores
• Provide official credentials or certifications

Accuracy

While we strive for accuracy, FernMath:

• May contain errors or bugs
• Should not be relied upon as the sole source of math education
• Is provided for educational enrichment only

8. Free Service & Future Changes

Current Status

FernMath is currently free to use. There are no subscriptions, in-app purchases, or hidden fees.

Future Pricing

We reserve the right to introduce premium features in the future. If we do, we will:

• Provide advance notice
• Maintain a free tier
• Clearly label paid features

9. Limitation of Liability

To the maximum extent permitted by law:

FernMath is provided "AS IS" without warranties of any kind. We are not liable for:

• Learning outcomes or academic performance
• Lost data or progress (though we try our best to prevent this)
• Indirect, incidental, or consequential damages
• Service interruptions or technical issues

Use FernMath at your own risk. We recommend students also follow their school curriculum and consult with teachers.

10. Children's Use (COPPA Compliance)

FernMath is designed for ages 11-15 (grades 6-9).

Age Requirement: Users must be at least 11 years old and have parental permission to use FernMath.

For Users Under 13:

• You must have parent/guardian permission before creating an account
• By using FernMath, you confirm you have obtained parental permission
• Your parent/guardian can request access to or deletion of your data at any time

For Parents/Guardians:

• By allowing your child to use FernMath, you consent to the data collection described in our Privacy Policy
• You can review your child's progress data within the app
• Contact us at fernmath@dasasian.com to delete your child's account
• We collect minimal data necessary for the app to function

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.

Informal Resolution

If you have a dispute, please contact us first at fernmath@dasasian.com. We'll try to resolve it informally.

12. Updates to Terms

We may update these Terms. If we make significant changes:

• We'll update the "Last Updated" date
• We'll notify you via email or in-app notification
• Continued use means you accept the updated Terms
